GENERAL PROVISIONS

1.1 www.rosianexpress.ro is the official website of S.C. ROSIAN EXPRESS S.R.L., headquartered in Mediaș, Str. Stadionului 53, Jud. Sibiu, registered at the Trade Registry under no. J32/1302/1992, Unique Registration Code: RO809541, hereinafter referred to as “Rosian Express”.

1.2 The purpose of the site is to provide, free of charge, information about the brands and products of Rosian Express to all interested parties. The site is operated and managed by Rosian Express.

1.3 When there are campaigns promoted by Rosian Express, interested parties will be asked to consult the relevant regulations in the dedicated section.

1.4 Access to and use of this site is permitted only in accordance with the terms and conditions below and with applicable legal provisions.

1.5 If you do not agree with the terms of use of the site, which includes the processing of personal data by Rosian Express, please do not use this site.

LIABILITY

2.1 Rosian Express cannot be held liable in any way to any customer who uses the site or its content, except within the limits of the articles that constitute the Terms and Conditions.

APPLICABLE LAW – JURISDICTION

3.1 This contract is subject to Romanian law. Any disputes arising between Rosian Express and clients/buyers will be resolved amicably or, if this is not possible, disputes will be resolved by the competent courts at the headquarters of Rosian Express.

3.2 If any of the above clauses are found to be null or invalid, regardless of the cause, this clause will not affect the validity of the other clauses.

INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS

4.1 The content of the site, including but not limited to logos, stylized representations, static images, dynamic images, text, and/or multimedia content, is the exclusive property of Rosian Express, which reserves all rights obtained in this regard directly or indirectly (through usage and/or publication licenses). These elements are protected by relevant legislation regarding the observance of copyright and related rights, trademarks, designs, and models, as well as patents and utility models.

4.2 Any reproduction or representation, even partial, by any means, made without the prior, written, and express consent of Rosian Express is prohibited and illegal. Non-compliance with this prohibition constitutes an infringement or an act of unfair competition, engaging the civil and criminal liability of its author.

4.3 The implementation of hyperlinks by any page of this site requires the prior, written, and express consent of Rosian Express. The use of any information on the Site for purposes other than consultative, especially for public, commercial, or humorous purposes, may be subject to legal action.

FINAL PROVISIONS

5.1 We make every effort to ensure that we protect and respect the confidentiality of personal data by implementing appropriate technical and organizational measures, in accordance with the requirements of Regulation no. 679/2016 regarding the protection of natural persons with regard to the processing of personal data and the free movement of such data and the repeal of Directive 95/46/EC (General Data Protection Regulation), Law no. 190/2018 on the implementation of the General Data Protection Regulation, and good practices in data processing.

5.2 For more details regarding the processing of personal data that the seller, as the operator, collects concerning the data subject when interacting with the Rosian Express site, we invite the data subject to access the Privacy Policy.

5.3 Rosian Express recommends all visitors to carefully read the entire content of this document and then address any questions regarding its understanding using the form in the “contact” section. A response will be provided within a maximum of 30 working days.

5.4 In view of the provisions of Regulation (EU) no. 524/2013 on online dispute resolution for consumer disputes and amending Regulation (EC) no. 2006/2004 and Directive 2009/22/EC, Rosian Express offers the customer the possibility to opt for the extrajudicial resolution of any disputes, by using the European online dispute resolution platform (ODR platform), a digital tool created by the European Commission to facilitate the independent, impartial, transparent, effective, fast, and fair extrajudicial resolution of disputes concerning contractual obligations arising from online sales or service contracts between a consumer residing in the Union and a trader established in the Union.
